NFT holders sue art gallery for failing to deliver promised metaverse perks and allegedly misleading investors

A group of 36 NFT holders filed a lawsuit against Eden Gallery and artist Gal Yosef, accusing them of failing to fulfill promised perks associated with their Meta Eagle Club NFTs, including a metaverse-based private club, raffles for exclusive experiences, and dividend-like digital assets.

The lawsuit alleges that the creators of the NFT collection, which sold 12,000 unique eagles and raised $13 million, did not take substantial steps to develop the Meta Eagle Club or possess the necessary expertise in blockchain and smart contract development.

The plaintiffs claim that the gallery and artist misled investors by promoting the NFTs with promises that were never fully realized, causing them to overpay for the NFTs and suffer financial losses.

The group is seeking damages, injunctive relief, and attorney's fees, accusing Eden Gallery and Yosef of common law fraud, unjust enrichment, and violating New York General Business Law.
